    Hello,

    My spouse wishes to invite her parents and hence we are going ahead for their visa interview. She was working on L2 visa and recently we filed change of status to H4.

    - Can she still sponsor the trip on H4 visa considering she has funds in her account and is not working any more?
    - She would be having pay slips from December and early January would that be enough?
    - Would it be a better idea to request in laws to self sponsor the trip?

      Thanks for your response. I am more concerned about her having funds in her account and not working. Would that raise a red flag? and on the pay slips since she isn't working now do you suggest it would be a good idea to file for the visa asap or time gap (b/w the last paycheck and visa appointment) doesn't really make a difference?

          Thanks for the inputs.

          Updating the thread:

          We have decided that I would sponsor my in laws. Now we are headed for stamping H1 - H4 both and we are planning to tag them along as well like a day or two post our stamping (fingers crossed for approvals).

          Though I have most of the documents the I94 would still be at the bottom of the H1B/H4 approval notices as we would be in India. Any suggestions that we should come back or at least I should so that I have I94 separate document and I can send it to them? i would also have the H1B visa stamp but then that might also be available while i am in India post the stamping!

            I94 is not a problem. They have everything on their system - no need to hide anything.

            Its fine, let them apply on their own. Or else you can have them go for the interview along with you.
