  • B1/B2 renewal was rejected

I appreciate if someone could help or clarify why I got rejection.

    My current Visa B1/B2 was going to expire by May, 2018. And at the beginning of the interview when I handed my passport to the consular officer she stamped on the visa ?Cancelled without prejudice? after that she started asking;

    Why are going to USA?
    For Tourism.

    Where in US?
    Chicago, Los Angeles, Las Vegas

    What do you work?
    Computer Engineer at the airport.

    What is your basic salary?
    7500

Since when do you live in here?
    I was born in here

When the last time you visited US?
    Last May, 2017

    Where did you go?
    Chicago, Boston, Portland, Newyork

And that?s it. She didn?t even ask for any papers that I brought with as Emplyment certificate, Bank statement.

After that she started clicking on the keyboard then handed me a paper with the passport telling me that my application was rejected, and the paper says denial under section 214(b), and another one with two fields for Section 212(a) You are eligible to seek a weiver of the grounds of ineligibility, and No waiver is available for the grounds of ineligibility. And she marked the second one, I don?t even know what that mean.

By the way I got the same visa type approved two times before and I went twice to US each one with a duration of 17 days only. But now the last Visa been cancelled by the stamp.

Even if I want to reapply I have no idea what papers they require or even why is the rejection actually for since the consular officer didn?t ask for anything.

Which country are you from? your salary 7500 is in USD or North Korean won ??

For tourism, you'll need to show strong earning to support your visit.

In USD it would be 2000
I was applying in Saudi Arabia where I was born and raise, holding a a diffrent country passport.

And I was holding a bank statement with a good amount but she didn?t ask to see it anyway. Which I belive is not the case of rejection.

When I was granted mine the consular didn't ask for anything. As a matter of fact all I was permitted to carry was my passport and appointment letter. I think they reject for simple reasons as in not enough visas to distribute. Each embassy has a limited amount of visas to distribute each quarter. It's unfair yes but given the political climate right now I think it will be even harder to get a B2 visa.

Maybe that could be the issue

USD2000 per month is too less to apply for US visitor visa (you easily need more than $3000 to visit Las Vegas). The definition of good amount in bank account varies from person to person.

There is no such limit for visitor visas. Neither its "luck" that you got visa. The VOs are mature enough to review your application & grant you visa.

VO can reject your application on an iota of doubt (your bad luck), but won't give visa unless he is 100% sure about you.

                B1/B2 renewal was rejected

B1/ B2 is indeed just pure luck. The VO officer can never be 100% sure about an applicant. Half of the times they don't even look at the supporting documents. If an individual has been to the US twice, twice returned to their home country and you refuse to renew their visa, except if they were tagged for some sort of activity, the VO just rejected that application because he/she can.

Not legal advice, just my opinion

Officer was not convinced you were a genuine visitor and that is why she denied your application and cancelled the remaining period of your current visa. You can reapply again since you have never done anything wrong according to you and what I can read. Officers are not required to read what you bring but rather rely on what you say. If you make $2000/m in KSA and you travel extensively inside the US on each trip it does appear to be a contradiction. How can you afford the trip ?

Well according to the US government website each embassy has a certain amount of visas to distribute per year. Also, I had no money in my bank account when I applied, yet they say you must have enough finances to go on a trip. Yea right! I was making less than $USD400 a month and I was granted a 10 years visa.

No minimum & maximum limit on B1/B2.

If you had no money, then you lied.

They do not always ask how you are financing your trip. Each IO asked different questions and makes a judgement call. You can be rejected today with one officer and be approved with another officer the next month, with nothing having changed about your circumstances. That's just how it is.

How did I lie? In my country when applying for a tourist visa they only ask that you take your passport and appointment letter. Nothing else because of fraudulent documents people have acquired in the past. The officer asked me what I did for a living, who I was going to see in the US and finally if I had any assets(I told her I inherited a piece of land from my great grandfather) which is true. Different countries have different rules. And in my country (Guyana) there is a certain amount of tourist visas appointed yearly to each officer to distribute. Saying there is no limitation in general is reckless because the department of state has to keep a record of each country's visa issuance. Besides, when I got mine I helped my best friend and her boyfriend fill out their application and they were successful at their interview.

Very true. I had helped some friends with their application and made sure my parents got theirs too because of the then upcoming elections I knew that if Trump became president there would be heavier restrictions.

                            Spouse B1/B2

                            Hello All,

While extension is in progress, can spouse apply for B1/B2 visa if she has her sibling stays in USA. mentioning her sibling as sponsor for her tourist visa.

                            1. What if B1/B2 visa rejected, immediately in 1-2 months if she needs to go H4 stamping upon my H1B approval?

                            2. In DS 160, spouse name needs to be mentioned. will it cause any issue for her at stamping?

                            Thanks in advance for suggestions!
