  • parents visitor visa rejected(214(b))

    hi Everyone,

My parents visitor visa got rejected on May 18th on the basis of 214(b).

When I refered to 214(b), it is due to lack of strong ties in India. But both my parents are government employees and they still have 1 yr of service. Also they have showed the property documents too. If they want to apply for the 2nd time, wht documents should they have in addtion. As nothing would change materialistically with 2 months.

My guess is that the VO overlooked their service documents.

Another concern is that I entered US as F-1 Student, got my H-1 but not yet stamped. My passport has still F-1 Visa. Do you think if this is problem for their denial?

    Thanks in Advance

    sorry.

    Kiran,

Sorry to hear about the rejection. Try it again and they will get it, be optimistic which I know you are...

I'm sure they had the letter from their respective employers (granting permission) to be away from work for extended period of time. Hope you asked for 2 mos. because realistically no one can be away their job for 6 mos. So make sure you request only for 2 mos.

Document wise: When I reapplied for my parents I sent them (in our case the gap was 4 mos b/w first and second appearance)
    - new I134
    - of course, new 156 and 157
    - new invite letters
    - new bank statments

I'd say just go over the list and if possible send an updated document if you feel the old one might raise issues.

Your F-1 to H-1 should not be a problem, as long as they have your copy of H1B petition (I797 form).

    Hope this helps, good luck

hi guys, thanks for the response.

My parents applied for visa in the chennai consulate. Also they took their vacation for 3 months only. Also if I check the dates now for appointment they are available in November.

Another question is what should they say,if the VO asks like what has changed from the last time they applied? Does the VO make a note of how much property my parents showed last time?

        Thanks
        Kiran
