  • Legal stay period in US under B2 question

    Hello

My parents in law had been in US in this year for 5.5 month,
I know with I-94 usually can stay up to 6 month.
When they can come to US again?
I read somewhere that in one year they can stay only 6 months total per year, is it true?

    Thanks

No, it is not true. They can try to come back at any time, and whether to admit them and how long to admit them will be at the discretion of the immigration officer at entry, as always. It is theoretically possible for them to come back the next day and be admitted again for 6 months; or they could be admitted for a shorter time, or denied entry altogether. It is impossible to predict. Of course, coming to the US too often for too long will increase the chances that the officer will admit for a shorter time or deny entry altogether.

This is my personal opinion and is not to be construed as legal advice.

No, There is no such rule for stay of 6 months total per year.

However, it is suggested to stay in home country for more than the period of stay in USA - to prove strong ties to home country.
