    One imp Q

    If u enter the US within the last week of ur visa validity(1 wk b4 the expiry) n watever duration of stay is granted... can u apply for extension later on even ur visa is not valid i.e. ur visa has already expired but not the I 94.

    According to site of USCIS wat i read was( n I am posting that);

    "Who is Eligible?
    You may apply to extend your stay if you were lawfully admitted into the United States with a nonimmigrant visa, your nonimmigrant visa status remains valid, and you have not committed any crimes that would make you ineligible."

    "YOUR NON IMMIGRANT VISA STATUS REMAINS VALID"

    wat does it mean?????can one not extend his stay then.....

    Ans )You can arrive in the US right up to the last date of validity indicated on the visa. The Immigration Officer on arrival determines the duration of stay in the US. Your visa can expire while you are still in the US - just ensure that you do not overstay the period permitted by the Immigration Officer.

      no medisid thats not wat i was asking......my Q can u apply for extension even when ur visa is not valid........i have quoted that point of eligibility from the USCIS website............hope immihelp can help us

          If your visa is expired and you do have a validity on your I 94, you may less likely to get an extension.
