Can I get a temporary restraining order against relative that my husband is inviting

  • Can I get a temporary restraining order against relative that my husband is inviting

    My husband and I are US citizens and he is inviting his brother and his family to visit USA. This relative has verbally abused me before on several occasions so that I have not visited my inlaw's place from last 10 years to remove myself from the unpleasant situation . Now I am afraid that he may verbally and physically abuse me if he stays in such a close proximity to me. My in-laws (MIL, FIL) have visited us before and their visit was pretty cordial but they have kept quiet on the verbal abuses that this brother in law has hurled at me. My husband is a timid person. Is there a way to protect myself from this relative? I am a petite and highly educated woman (PHD and highly respected for my work) with a severe back problem and this relative is an uneducated person (high school) with a strong built. (I am posting this extra information out because I am afraid if he starts abusing me, I will not be able to protect myself physically). He tried to get a tourist visa 2 years ago which got denied but this time he is making my timid husband sponsor him.

    well first of whether or not he is educated has no affect on whether or not he will or will not be abusive, secondly, you can kindly ask that your husband not invite him. other than that, if he touches you and you have proof of it, you can always file a police report.

      Thanks ! I posted the information on his education level to find out if that has any effect on the tourist visa. I heard somewhere that if a person does not have a college degree, they are considered to have no ties in India. I put the physical stature information because I have no match to his physical strength.

      Also, do I have to wait for him to physically abuse me to get a TRO? Is there a preemptive approach to this situation?

      Also, DH is too timid to say anything against this brother and so are his parents. This guy is a menace.
