  • Visiotr visa critical situation

    I am a physician was granted 1 yr multiple entry visa last for giving meidcal exams in US. I stayed their gor 5 months and came back than again went back to US to volunteer in research now my visa has expeired I have to again face interview. But in this 1year my parents status has changed they are now GC holder. will this giong to affect my visitor visa chances.
    1. This time my purpose of visit to US is to attend interivew for reisdency in hospitals and give medical exam.
    2. I want to visit for 1 months.

    I have my private practice working with my father in nursing home. I stayed their to have exprience of US medical system. So I stayed their for 5 months.

    Is their any way u can suggest I can convinece VO about my stay. As u know my whole visa situation now.

    I will appreciate for your reply.

    looking to above stuation will my parents GC status affect my chances.

    please drop your suggestion my I am totally confuse with my visa sittuation.

    I am a physician too and I'll gladly give you advice but I am not clear about a few things you mentioned;
    1. Where are your parents now? In US or in India? Who sponsored for their GC?

    2. On both the trips to US, did you ever overstay the date on your
    I-94 card?

    3.How much time did you stay the 2nd time?

      Thanks for taking interest to my concern

      My parent in India on re-entry permit, got GC six months back. GC sonpsered under F4 category. During last interview they were not having GC.

      I stayed for 5 months first time next time 2 mnths.

      No immigration petition filed for me.

      I did not overstayd in US. But during that time I did shadowing and volunteer research work and gave couple of exams. What should I mention VO if he ask why I stayed long time than what I mentioned in my last interview.

      Can I say I volunteered in research and shadowing. I have lor to show them.

      This I am going for another exam and interviews. Hope u can guide something from thsi info as I am very upset with my visa issue. Waiting for ur reply.

        It is only a major problem if someone overstays. If you returned within the
        time given on the I-94, even if it was 5 months, it is not a problem. In my opinion ,you should not worry. I once asked for a few weeks but stayed
        4 months and I still got a 10 yr visa the next time.

        In case the officer does ask you, you can say you spent all those months
        visiting a lot of hospitals, meeting many friends, with an objective to familiarize yourself about the American hospital system. And I strongly advise you NOT TO tell the officer about research volunteering
        and shadowing because it is not ususally permitted on a B1, though people do it all the time. The type of volunteering allowed on B1 is with charity or
        religious organizations mostly.


        If you do not mind I''ll ask you a few more qs about the rest of your question;
        1. What did you tell the officer at entry, about your purpose of visit, the 2nd time? How much time did he give you on your I 94 card?
        And what exactly did you do during the 2nd visit? Did you take any tests?
        Did you meet any relatives?

        2.About your parents' GC situation; Do they have any other children in US
        and India besides you? If yes, what do they do?
        Who is running their practice for the time they are in US on their GC.
        What are their future plans about the practice? Do you plan to run it
        or all of you plan to abandon it and move to US eventually. Tell me the
        honest picture.

          How much time did he give you on your I 94 card? 2nd visit 3 months.

          And what exactly did you do during the 2nd visit? Did you take any tests?
          I took reseach test, I cleared it. I visited few hospitals wher my friends got resiedncy and did volunteer research work
          Did you meet any relatives? I have no relatives, except my aunt family, To whome I never interacted (As they are completely American)

          Who is running their practice for the time they are in US on their GC. Parents went for 1 months, now on re-entry, hospital managed by other physicians who are employed?

          honest picture. New Nurising home is in my name I am the owner and have done lot of expenditure to setup ICU and gyn unit. Also have well established school.

          I can not think of abandoning we have well reputed hospital and school, Its a prepared field for me. truley speaking I can make good money here. Have all the document to show this.


          I think u have complete picture of my status. Well still don't agree with point that I should not mention about resarch as last time VO asked me lot about my research interest and research work in India.

            There is no need to worry at all. Your case seems fine.

            Q1. Why do you wish to go?
            [I]To appear for interviews for residency. I have already visited US twice on a one year visa to take the tests.

            Q2. Show me your test scores and the interview letters from the hospitals.

            Q3. What do you plan to do after the residency?
            To come back and run the hospital that is in my name. I have recently
            spent a lot of money on it.


            Q4.Why do you wish to go for the residency in US when you actually
            plan to settle in India?
            To get the best experience possible which I can use when I come back.

            He is not going to ask you why you stayed 5 months or why you visited twice, since you did not overstay both the times.

            And even if he does, you have good explanations for both the visits;
            taking tests and visiting hospitals.

            Talking about research was different the first time; the officers try to assess a doctor's research potential the first time (because research people are welcome in US).
            You can say you took the research test but do not take the risk of saying you did research volunteering because it is not really permitted on a B1 visa.

            The only point is about your parents' GC. The officer will want to know why you wish to settle in India while your parents will stay in US as GC holders.
            since they do not have any other children there.
            It seems unnatural by the Indian culture. You will have to explain about that.
