    Hi, It is about my mother-in-laws visa application:
    I want to apply for her to visit here on a tourist visa in the US but she was refused atleast 4 times on a business visa application over the past few years...She was unable to find out what was the reason for the refusal.

    I need an advice regarding before we go ahead and send a sponsorship...we need to find out what was/were for her refusals so we can prepare her accordingly. She visited US before on a tourist visa once before (2000) and since then she applied again for business visa, during one of her past interviews, she misunderstood the counselate officers' question about whether she had worked in the US, she said "YES" but she didn't because she is unable to talk in fluent English.

    We could not find out the reasons for her refusals, and the counselate wouldn't tell her, so how can we find out the EXACT reason?

    Her last business visa application refusal was in early 2005, so can we apply now since this time she will be applying for the visitor visa, will she get it?

    Please advice.

      Visitor Visa Help for Mother-in-law

      So, Should we apply without knowing whether it was a bad rejection meaning cannot get the visa anymore? or can we hire a lawyer to find out the exact cause of the refusal?

      Please advice.

        Those are very generic reasons that people get visa rejected for. It is not possible to get any more specific information than that.

          It may be possible to get another visa
          with a proper preparation. AND most importantly by opting for a non-Engish
          interview at the embassy.
          Please post more details;
          *about the last interview , I mean what questions was she asked and what she answered, whatever she remembers. What business purpose she said she was going for, what documents she showed?
          * what does she do in India? What is her income?
          * Does she have any immediate family in INdia? Who all?
          * Does she have any immediate family in US? WHo all on what visas?
          * Has she ever overstayed her stay in the US?

            Ist Attempt: She got a visitor's visa approved for 6 months..travelled & stayed for 6 months and returned on time in August 2000.

            IInd attempt: Around Nov 2000, one of our relative convinced her to reapply again in order to get a 10yr visa (she doesn't recall whether it was a Business or Visitor visa application) BUT with a group of people through an agent...she got a stamp since it was sent through her agent...he didn;t know what it was & neither didn;t she...so she thought it was refused but turns out the US embassy wanted her to come in person for the interview & thats what the stamp was for...so she never showed up.

            IIIrd Attempt: She reapplied in April 2003 as a business visa application
            Here what VO asked:
            VO: Why didn't you show up on the previous interview
            She: Because I thought that It was refused.
            VO: While your visit in US in 2000, did you work?
            SHE: Yes
            VO: Did you have any work permit or social security?
            SHE: NO
            VO simply stamped for the refusal and also Wrote: COWP on her previously issued visitor visa in 2000. PLEASE TELL ME WHAT THAT MEANS?

            IVth attempt: March 2005 Businessvisa application
            VO: Why do you want to go there?
            She: TO get some orders for sale
            VO: went inside ...came back after few minutes and refused it.

            While all her visits, she did not have enough monetary back up to show except her house as a collateral and also that she wants to start a business with her sister who is already in this business and she will help me get started. But she didn't got a chance to explain all that and now here we are?

            Please tell me if there can be any solution to apply for her visitor's visa because I want my wife to spend some time with her since they have been apart since 6 years now. She cannot frequently travel because of her work and college here in US.

              It was a good advice by a relative intitially to get a 10 yr visa but it got messsed up by the agent not knowing what the stamp was.
              And next , she messed it up more by saying she worked during her visit
              ( it is violation of law to work on a visitor visa).

              Anyway, we will try to set it right, but it is extremely important that
              you tell me the following;
              1. What does she do in India ( for how long)and what her annual income is?
              2. How well does she understand and speak English? Did she actually work during her last visit or she simply answered yes because she did not understatnd the question?

                Well she does not work anymore! we send her money occasssionally when she requires it, but she has ownership of her house in India through which she makes rent money...but its all cash. and she lives close to her house with her sister.

                2. No she did not work in the US...she was very nervous during the interview and ended up saying Yes...she does understand common english but can't speak that much.

                Please give us a solution.

                  You have not answered my question in my first reply who are her immediate family in India and in US? I assume she is a widow and has no children in INdia. ANd her only daughter is in US that is your wife.
                  If that is the case,
                  it is going to be very hard because she has no occupational ties to India either.

                  NO family ties and No job ties to India. These are the two ties officers look for.
                  The most common reason for refusals of visitor visa is 214b ; when the officer thinks that he does not think you have enough ties to return to India
                  Every time she applies, she will be suspected of not returning because she
                  has no family or job in India and she has her daughter in US where the officer will think she would like to be.


                  Please explore other visa options for her. When is your wife going to become a US citizen? Does your MIL have a bachelor's degree? How old is she?
                  Can she work?

                    Thank You for the advice, but I have another thing to ask:

                    my Mother in law doesn't work because she does not have to...meaning she practically lives with her elder sister who happens to be rich, my MIL takes care of her because her sister remains sick most of the time-she has severe arthritis problem. So my MIL cooks and even has a signing authority of her checks and balances in her accounts, her sister get income from rent that she has 2 industrial plots on rent and that's how they survive. My MIL is the only family her sister has because their parents died.
                    Do you think if she(MIL) shows that she lives with her sister and that sister takes care of her expenses and even has signing authority on her bank accounts...that will help?
                    Also, my MIL has her house in her name that she puts on rent but she gets cash for that rent. and also she has some type of Fixed deposits on her and my wife's name.?

                    Do you think if we put together all these paper work...can that convince the VO that she will come back because she has to take care of her sister...we can get all the documents regarding her sister's illness and doctor's notes that she requires assistance for taking care

                    Also, My MIL is 47 years old, no education and no job experience so can;t work.
                    Please advice

                      Well, it all depends on the officer who interviews you. Many officers will assess ties on the basis of standard questions; do you have any family in India ? What is your income in INdia or what do you do in India? Who is in US?
                      And will close the interview if not satisfied, NOt giving you any chance to explain.
                      Since you have no other recourse, give it a try, though chances are not very good. But how will you show the cash income they get; since they file no tax returns?

                      I guess the next best thing is when your wife becomes a citizen, she can sponsor her mom for an immigrant visa.

                          Like I said, you may give it a try;
                          *Opt for a Hindi interview.
                          *Let her open the interview by saying that she has been denied mistakenly
                          on previous attemps because she said once that she worked on one of her trips; though she did not . It was just a case of not understanding English.
                          *Ask for a short stay of 2-3 months.
                          *She will have to show all the financials of her sister all that you described
                          will be fine. Put them on a CA's letter head (one page for a quick glance)and have him attest it.If possible, take originals of every financial doc.
                          *Let her say she is self financing from her deposits.

                              Although I do have few more questions, I am sure they will come along once I start my MIL's application.

                              I want to know that my wife visited her during this summer...is there anyway that the VO can find out that she visited her mother in summer? because othervise before her visit...they did not meet for past 6 years, so she can tell the VO about that..is it possible?
