  • Urgent Help needed (4th time Visa rejected for my parrents)

    Hi Friends,

    My parents were trying to visit me from the last year, 1st and 2nd time they applied in 2005 to attend my Graduation ceremony but they were refused without even seeing the paperwork sent by me or the paperwork from them (Ist Visa interview was in Oct and 2nd in Dec, 2005).

    In November first week I tried their visa third time as my status got changed from F1 to H1Bi, this time also VO doesn’t even bother to have look on the documents sent by me (3 yrs Tax returns (W2), Affidavit of support), personal letter, letter to consulate and letter from employer. All the three rejections were under section 214B.This time I told my parents to go again (on 28th Nov) and I sent a new set of documents but they got the refusal saying that the law doesn’t permit them to visit to their Son if he is on H1B1.Infact during the fourth interview he looked into all my documents and at the end refused their visa under the same section (214-b). After the interview they really got shattered and now they don’t want to appear again (As far as my parents documents are concerned they showed about 17 lacs Liquid plus home and Agricultural land, as my father is a retired govt officer and mother is running a small business of garments to keep herself busy). As far family ties are concerned we are two siblings (Myself working here on H1B1 and my sister [She is happily married and well settled].

    Could anyone please give me his/her valuable suggestions so next time there is no disappointment.(In all these attempts both applied for the visa at New Delhi)

      I was wondering why they have to refuse the visa so many times and also why they are saying "LAW doesn’t permit them to visit". This sounds peculiar to me.

      Can you give more details about you? What year you came and what visa you were holding at that time. Did you have stamping in your passport for the H1B visa? Did you overstayed any time in this period?

      If the sponser document is not good then there is a problem when you sponser others. You can ask them to self sponser to visit USA.

      I hope this will give you some idea.

        Help Needed

        Hello friend,
        I came to US on F1 in Aug 2003 for my M.S and during my studies I got a job offer as an intern and they offered me a full time job .After the completion of my degree (in Aug 2005) and I worked on OPT for 1 year and they filed my H1 in 2006 cap and I got the approval of H1 this year in June and it started in oct 2006, It is not stamped as yet .I never gone out of status during my stay in US.
        Last year I got married here with a girl who is also studying here (on F1 and still on the same status).
        In first attempt, I sent all the documents along with the invitation letter from my Graduate school also about the Graduation ceremony and the VO didn’t saw those papers along with theirs and refused the Visa in oct 2005
        2nd attempt we tried in Dec 2005 as the ceremony was in the same month and they refused the Visa by saying that the invitation letter they are having with them is the same as it was during 1st interview.
        3rd attempt, we tried on nov 8, 2006 after getting my H1 approval and this time VO didn’t saw any paperwork and refused the visa.
        During 4th attempt they saw almost ¾ th of my documents and after seeing they said that is your son on green card (answer was no) and the VO told them the American law doesnot allow them to visit USA.
        I am not understanding what should be the reason behind the refusal every time VOs gave them the same paper on which it was mentioned that the applicant didn’t satisfies VO (under section 214-b)
