Needs urgent sugession for my daughter H4 extension

1)My daughter visa is expiring on 01/05/2007 and she is comming with my mom on 9th of this month. Do they have any problem in port of entry because her visa is validfor another 26 days only from day of entry.

2) Can we apply her extension once she comes here? her passport will
be expiring on March 2009 but I have my extension up to 01/05/2010. Do
we need to get her passport first before we apply for the extension? If
so is 25 days is good enough to get passport and apply for extension?

3)We asked our lawyer, He is telling you are taking risk because if you apply for her extension now it may take 9 months to get approved. If by some chance if it was denied then my daughter cannot come back to US for couple of years.

4)My question what happens if my daughter comes to US and go back to INDIA before 5th Jan, Shall I go back to India and get her visa stamped along with my H1 stamping.

5) Can I use her same passport valide upto 2009, as she too will get visa upto 2010 if she has passport validity upto 2010.

Please give me suggestions for all my questions. For the past 2years I haven't seen my daughter. She is 2 year 10 months

Hi,
There wont be any problem to enter at this point of time. For safer side you send a fax addressing the personal at port of entry that you are going to apply for extension as soon as she was here. Generally H4 extension rejections wont happen hence don't worry about it.
