  • Please clarify parents interview affidavit, income tax and interpreter doubts

    Hi,
My parents are having visitor visa appt on Jan 22nd in chennai. I have couple of doubs regarding some docs etc required during the interview. Could you please clarify:
    1) Whats a good format for getting affidavit of property and return? Were in India this can be made? I mean do we need to take it in a stamp paper in court? Is it required for both dad and mom? My dad is retired and my only elder brother is working, married with a kid. All my grandparents have passed away. So what all we can include in the affidavit for good reason for return.

    2) My dad is a retired defense personal since 2003 and is not paying and filing tax as he is under Rs1 lakh limit. Is it required to show a proof that he is not supposed to pay taxes. If yes, how can we get this?

    3) English is selected for interview. My dad speaks english as ok and mom can speak only Malayalam. I hope in this case interpreter is not required. How can we then handle the consular/officer question specific to mom. In this case should my dad ask the question to mom in malayalam and translate back the reply in english back to the consular. Is this procedure fine?

    Thanks,
    Vinay

*First of all one does not need an affidavit to prove that one will return to India. This assessment is made INDIRECTLY by the officer looking at the person's family and occupational situation in India, and by what and how the applicant answers the officer's questions.

*Secondly , please keep in mind that documents only have secondary
importance. In a large no. of cases, decisions are made by Q and A only without the officer looking at any documents.

*Your dad won't need to show that he does not file IT returns. They will believe him. They look at evidence for positive answers.

*An assessment of assets on a CA's letter head should do.

*Your dad can start to answer all the questions and can speak for both of them.
