H4 to H1 status cause any issue for B2(Tourist) visa?

  • H4 to H1 status cause any issue for B2(Tourist) visa?

    Hi,

    I am on H1B visa and currently working. My wife came to US on H4 visa and she got her H1 3 months back. But she is not working and still looking for job.

    Now my question is, i am sponsoring B2(visitor) visa for my in-laws ? as my wife is on H1 with out any pay stubs, does it cause any issue for getting tourist visa?

    Do i need to send my wife's I-797 document when i am sponsoring for her parents ?

    If any one come across this kind of situation...

    please let me know.

    I dont know if not having paystubs are going to cause any issues or not. But I know for sure that you need to send the H1 approval notice.

    This is waht happened to my parents, when they applied for visa (even though my husband had sponsered), the VO asked them for my H1 papers. At that time we hadnt send them the papers, so they got rejected. For the 2nd attempt, we had sent them my H1 approval papers, and they got the visa. I dont recall the VO asking my parents for my paystubs, even though we had sent them.

      If i understood correct, you are telling me that i need to send my wifes I-797 also even if she does not have pay stubs..

        Thats what I am not sure what to say to u. What are u planning to show in the application, that whether your wife is 'dependent' on you or 'partially dependent' (which is what one will be selecting if their spouse has H1 and working)?

        In my case we selected partially dependent, which is what VO saw and asked my parents for my H1 papers.

        I am not sure what will happen if you send the approval papers, and then say that you dont have paystubs (in case the VO asks for them, which i feel is a very distant possibility as you are the one who is sponsering).

        I am sorry If I am confusing you more. But I can only share what was my experiance was. If someone else has something to say regarding this, Please do.
