  • Parents Visa rejected twice

    Hello:

    My Parents Visa was rejected twice at the Chennai Consulate. Both times the VO said that if both your kids are in the US, we cannot issue a Visa. Additionally, she also mentioned that the US law is such that if all of your children are residing in the US then a Visa cannot be issued. This is absurd as I know people who have got Visas by stating that their children, all of them, live in the US. My Mom has a job and so is my Dad and what is interesting is that my in-laws got theirs the first time b/c they have a son in College and they are well in their 60s.

    Anyway, they want to apply for the third time now. First time was in May06, 2nd time was in Oct 06.

    Any constructive/useful suggestions would be greatly appreciated

    Tips;
    *Let your mother apply and travel alone first. Dad will act as a tie in India.
    *If they have good finances, let her show she will be spending her own money. You need not send an I-134 in that case.
    *Let her ask for a short stay 2-3 months.

      1) Give atleast 7 months time before applying next
      2) Provide enough financial ties in India.
      3) Attach family photos with close relatives .
      4) You can personally write a letter to VO to say that
      you parents are not intending to immigrate here.
      ( Mention all the reasons why would they return).
      (In the Letter you can mention, you may return back to
      India after some time. So that your parents may not stay here.)
      5) When VO ask how long your parents want to visit ,
      Let them say 1 or 1.5 months.
      6) Since your parents are working, let them provide their obligations
      in their job.


      We have to do all these for US Visa only. Not for other countries.

      Because US Visa officers blindly trained to think that everyone who comes to USA is a potential immigrant.

      To overcome their presumption , we have to go out of the way to prove it.

      What can we do?. if we need it, we have to bend before them.

        I know excatly how you feel. My parents visa was rejected 3 times so far and for the same reason. I did everything I gathered from this web site. I wrote a cover letter stating the my parents are not potential immigrants. We waited for a year before reapplying. The VO (same lady you are talking about) did not even read the cover letter. My mother requested her to read it and she just ignored her. My brother is on H1b and his visa is expiring in sep 2007, but still she rejected my parents visa.

        My parents are so disappointed, it so taxing and stressful for them to preapare and go through this painfully process again and again, just to get their hopes crushed.

          I have been reffering to this website but even then my mom has been rejected Visa four times. As suggested in this post that we need to write a detailed letter to the officer stating that our parents are not a potential immigrant. Every body says that none of their documents are seen so how can we then prove that our parents are not an immigrant by writing a letter if it is not read.

          At least if the officer suggests what is the reason for rejection may be we can correct and reapply. otherwise it is just harrassing old people.

            I agree with Sama. US , as much as it is thought all over the world to be an icon of honesty and fairness in its systems , should bring in more consistency and justice in its issuance of visitor visas. Poor old parents travel to US consulates from far and wide and get a denial without a fair interview.
