  • Mom Visa Rejected Second Time :-(

My Parents went for Tourist Visa on Jan 12th for the first time. Rejected based on 214 b(as both the sons are here).

Today 28th March i sent only my Mom for a shorter duration of Visa and she is rejected again for the same reason. This time my Dad didnt go. We thought our dad will act as a tie back in India. But this time they were asking several times why yr husband didnt come ? I am upset and they are depressed. Dunno what to do. May be try again after 6 months !

Me and My Brother sent Sponsor documents.
My Mom is a Retired School Teacher with pension and Dad doing business/farming.
My Mom is working with a NGO as well.
We have a Sis Married in India with a Kid.
They had photos and documents for all. But of no Use.

    What else to do ?

    refused 2nd time!!

    Raj_Raj,
My parents visa got refused too. This is the 2nd time they appeared for visa as well. Last time it was under 214 b.
Today, the visa officer was not interested in looking at their paperwork. The reason for refusal this time is that both kids are here. Both the times both my parents appeared for the interview.
Both retired from Govt service, earning pension.
Last time my brother sent documents, this time my husband sent.

Don't know how to prove that they only want to visit for 2 months.

THe officers probably log on to immihelp too. THey know people use this
plan to apply alone once both are refused together.

What was the answer she gave to the q why your dad was not going.
She must have answered unconvincingly hence the denial.

Since there have been two rejections in two months, I would suggest that they wait ATLEAST 1 full year before trying again.

Another suggestion - in my own case, my parents applied for and got a visitors visa 6 years after I came to the US. I think waiting also helps strengthen their case because it proves that the parents are not desperate to get to the US very soon after their kids get there.

So if it hasn't been very long since your bro/you got to the US wait a couple of years.

          Thanks Guys

          To Budha
What was the answer she gave to the q why your dad was not going ?
She told them that My dad is busy in his business now(actually he is) and cant make it this time and also he wanted to stay back because last time the VO told them that they had less relatives in India.

          To Mohanty
I came 3 years back and my brother is here for almost 10 years. Never applied Visa for them before. I will wait for another year before applying. Lets see what happens at that time.

s_kon, Wait for a year before applying. Good Luck.

          Will keep u posted.

          Thanks,
          Raj

Your mom gave two answers to one q ; the first part was right , she should not have said the second part.

              1) I/My Brother is going to apply after 1 year for both of them and going to ask them to Self Sponsor. Any thing else i have to do keep in mind at that time?

              2) I am on H1b. i am planning to go back to India permanently in 3 months time as my current project will be over at that time and as my wife have to complete her Masters in India. So next time when my parents go back for the Appointment, how can they prove the fact that i am back in India and my brother is the only person in US ?

              Please let me know.

                Raj_Raj,
Good luck for your parents next time. Sorry for posting the details of my parents refusal here. When I read most posts it seems like self sponsoring may yield a result.

Also I came across this in rediff.com. Peter G Kaestner, Minister Counselor for Consular Affairs and US Consul General, New Delhi, answered visa related queries during a chat on November 29.
                <http://www.rediff.com/getahead/2006/dec/30visa.htm>

read and see if it's any help to you.

                Good luck again.

                    1. I think your mom should apply alone again. Train her to answer convincingly
about why your dad is not going. She should show your dad's business engagements in INdia
                    during her visit period.

                    2. It may come up during the interview. If it does not, she should
volunteer that info to the officer in a tactful way.

Thanks chennai_123. I am going to wait for another 1 year before applying for them again. But i dont know if they will be lucky even at that time.

I am on H1b. i am planning to go back to India permanently by end of August as my current project will be over at that time. So next time when my parents go back for the Appointment, how can they prove the fact that i am back in India and my brother is the only person in US ?

                      Thanks,
