    Hi,

    My mom got B2 visa for 10 years. I have heard that they can stay maximum of 6 months when they enter US.

    Can my mom stay 5 months in US, then go back to india for 1 month and again come back for 5 months. Can she keep on doing this or will this be suspicious.
    How long can she do this?

    The reason I am asking is because, I am married and stay with my wife on H1 visa...my mom is alone in india...

    I am sorry to say this but if you are so worried about your mom then you either need to stay with her in India or make alternative arrangements.

    She can only spend 6 months in a 12 month period she might get away with doing what you suggest for a year but she stands agood chance of getting her visa canceled for misuse.

    It is ironic that just before your post i read of someone desperately trying to have their mom visit for a few weeks, but is unable to get the visa because of the precedent set by people like you.

        Or all those that didn't got an H1 visa, and then you read about all those that "got my visa X years ago, but never actually went to the US" ?

          Well, when she comes back one month after she leaves the US she is going to be asked very tough questions as to why she is returning so soon after she left. And saying that she is alone in India is not going to be a valid reason. In all probability she will get a much shorter duration of stay stamped in her passport (3 months, one month etc.). She is not going to keep getting 6 month stays stamped on her visa if she keeps returning a month after she leaves. And if she tries to return again very soon after the second trip she could be sent back home from the airport itself and her visa could be declared void or invalid.

          The fact is she has a tourist visa which means she is supposed to do what any tourist does - spend more time in her home country than in the country she is visiting.

          So stop abusing the rules underlying tourist visa that your mother has been fortunate to get.
