  • Visitor Visa for Mentally Retarded Brother

    Hi,

I'm on a H1 visa and planning to apply for a US Tourist Visa for my parents and my brother who is mentally retarded (age 33). He requires supervision by my parents, as he might not be in a position to respond to questions, if interviewed alone.

I had a bunch of questions, would really appreciate if you anyone could answer my queries based on similar experiences:

    1. I have heard that young people have a high chance of their visa getting rejected due to immigration intentions? Will my brother's case be considered as something similar to this?
    2. Should i get interviews scheduled for my parents first and then get an appointment for my brother, or they all should go together? Or it doesn't matter in either case?
    3. In both cases, can my father answer to questions on behalf of my brother?
    4. Apart from a certificate from a hospital indicating my brother's status, is there any other document required to be submitted?

I did some research on the net but couldn’t get satisfactory answers to the above. It would be of immense help if someone could offer responses to these.

    Regards,
    Haziq

I do not have definitive answers to all your questions, but I can say that it would be beneficial to schedule interview for all family members together, including your brother. And I think this is possible while scheduling interview. It is consular officer's job to assume all visa aspirants as intending immigrants and it is the responsibilty of all applicants to convince officers of the contrary in order to succeed in getting visa. Same will hold true in your (family members' including your brother's) case too. If you are intending to get some medical/psychological treatment for your brother then you can mention the same as the reason. It might be of some benefit in his case.

    Not a legal advice!
