  • Re-Visiting USA within a month on Visitor visa

    My Mom has 10 year multiple entry visa. She will be visiting USA again within a month of her last visit. Will this cause any kind of problem at Immigration. Is there any kind of paper work that will help? If anyone had similar experience please share.

      She stayed for 6 months (no over stay or extension applied)

        Your mother will be taking a big risk if she comes immediately after staying 6 months in USA. What answer she will give at POE if asked why you have come so soon?

          I agree with the two posts above.

          She can not expect to live for another 6 months in the US. And then what? leave for 1 month and come back for another 6 months? That is not a "visitor".

          She should spend no more than 6 months, PER YEAR. In the US with a visitor visa. And that is even pushing the limit.

          She will be questioned at the POE and unless she can provide any real evidence why she needs to be back in the US so shortly she will be sent back, or she will receive a restricted I-94 allowing her to stay for maybe 1 month. The worst, is that she will be "flagged" in their system as someone who may be an immigrant risk and be questioned more (and even sent to Secondary Inspection) every time she comes back to the US.

            Curious to know what happened

            I am real curious to know what happened. We have on a fairly regular basis these questions and would like to have a post-report on what **really** happened.

            As the others have said - my advice is to take it easy and have her come after at least 7 months. Or start the GC process for her.

              Advice others are giving is not baseless.

              People are routinely warned at the airport not to do this again, get 1 or 3 months I-94, or even asked to go back and denied entry.

                      Guys,
                      I'm in a similar situation and need an advice. My Parents visited us last year from July-Oct (4 months). We are expecting a baby soon and couldn't schedule an appointment for my In-Laws to come help us in the delivery.

                      I'm making arrangements for my Mom, to come on a second visit next week. What should she mention as a reason for her immediate visit (after 2 months), and also how much time can she request. Is there any risk involved here.

                      Also, wanted to mention that my Dad is not traveling with her this time. Can that help us anyway.

                        Parents helping with delivery will be seen by immigration officer as coming to "work" taking away an "american job".

                          islander - apply for GC

                          islander - Sponsor her GC. May be the easy way out in the long run. No need to worry about all this visa business. Hop in and hop out of a plane anytime.

                            a GC is for her mom to live in the USA permanently. Not so she can visit whenever she feels like it without the hassle of visas. Stop giving advice on how to "trick" the system... Which in the long run will do more harm than good.

                              No no PraetorianXI - I happen to know a lot of folks with GC that live in India after applying for the parole or whatever is needed to stay for 2 years outside the US. Keep in mind that the US visits for old parents is only for a transition phase when they need to help as part of the "free nanny deal" that all Indians expect from their parents – no need to sweep that fact under. That will wear out after 2-3 babies and they get too old to do the "free nanny grind". So it is a smart move to preemptively sponsor for the GC well before the baby and not have to deal with all this tension and high blood pressure during pregnancy. When all this is old - dump the GC and stay in India. With the GC, there is this big benefit of unconstrained stays in the US. How many times have you seen people almost in tears in this forum about wanting their mamas and papas back in the US soon because of this and that?
