  • Strange situation, appreciate help

The notice date when it was processed is oct 13, recieved on 16. I really appreicate your thoughtful answers, thanks. I have follow up question. Since it was taking so long for processing, to be on safer side I decided to send my mother to canada last month to spend some time with my uncles family. Now she is going to leave from there back to home country so technically she has left the country before expiry of 3 months extension and is not out of status. Does this make her safe when she comes at the POE ? My initial message got deleted by mistake, fortunately Praetorian XI message has everything. I am keenly awaiting response from our senior members about the I -94. Should she submitt the new I-94 back ?

    my questions are

    1) Is this a mistake I just have to ask for correction ? No mistake, most visas extensions are issued from the date of application. Technically, she was allowed to stay 3 months after that application. What is the date of the notice sent to you though?

    2) when she should leave so that she does not loose her 10yrs of multi entry. There are various opinion. ASAP, 2 wks , 30 days which is true? As soon as possible. She may or may lose he visa now though, it is at the discretion of the POE officer next time she comes.

    3) what are her options ? Not return for the US for at least 1 year. Keep the evidence of the application, copy of the I-94, decision mailed to her and WHEN it was mailed.

    4) Is she out of satus now ? Yes.

I will sincerely appreciate your response, Thanks
