  • Visitor Visa - Complicated

    Hi All,
Firstly i am quite new to this forum, please tolerate with me. I have a very complicated real life scenario here. Im in US on H1 and one of friends almost more that 15 years of friendship wants to come to US for a short trip on a visitors visa. She is been married long back and currently in divorce, the case is still going on and going to end soon. i wanted here to spend some time with me. Whats the best approach for her to get visa to travel to US for a short time. Ive been seeing people talking about visitors visa for parents, in laws, so far ivent seen any situation like these.
My request for everybody is please guide my friend how to get an visa to come down to US for a short trip, what documents needs to be submitted, if i sponser will it work fast.
Few questions which came up in my mind, is like does she needs to get an NO Objection from her husband, her parents are ready to give NOC for her and ofcourse the husband wont give at all. Does she needs to give any financial proof, she doesnt work now, she quit the job. Im not sure what documents she needs to submit, or if i sponser is there greater chance for her getting the visa. What probability is there in getting visa for my friend
Like this ive have many questions and confusions, can anybody please help me out. It would be great helpfull for my friend who is been almost suffering from many years. The trip can give her bit relax, i hope everybody understands.

    Thanks
    With Regards

    Hi Veena,

You can definitely sponsor your friend to US on B2, but ur friend will have to prove to the VO that she has strong ties in india and that she intends to come back to India ...It would be good if she can support or rather show adequate funds in her own account. Regarding the NOC i am not quiet sure, probably you can wait for some more time for some senior members to comment on.

She should definitely get a job and show that she has financial/property/family ties (doesn't have to be soon-to-be-ex-husband) in India and just needs a vacation away from her stressful current situation. But the bottom-line would be having ties to her country- that is a job/property/finances/family/etc.

Why she would need any "permission" from her soon to be ex-husband for anything is beyond me. That doesn't sound right.

        hi veena

Surely ur friend can visit US on B2 visa.
(The B-2 visa is for foreign nationals seeking to enter the U.S. for a short time for the purposes of tourism, social visits, or other recreational activities.)

        Important Documents :-
1.An individual passport valid for travel to the U.S.
2.fully completed and signed Visa Application Form - DS-156 and DS 157
3.One recent (within the past six months) passport size photograph, 50mm X 50mm with a white or off-white background.
        4.An invitation letter from you.
5.Photocopies of the sponsor’s proof of status e.g. Green Card, naturalisation certificate, valid visa etc.
        6.fees (i.e. Rs. 4000/-)

          Hi All,
Firstly i would like to say THANK YOU for all of your replies.
In Immihelp, i have seen two ways of doing it one is document - sponser (inviter) and another one is documents - visitor. Which would be the best way of approach for getting the visa easier, i knew luck certainly matters a lot.
What documents, you suggest for showing strong ties in India saying she will return back to india, knowing the current situation.
There are list of documents shown in both document - sponser (inviter) and documents - visitor, do we need to get all the documents.
Do my friend can directly do herself for getting the visa or she needs to approach any brokers or travel agents.

          Thanks
          Best Regards,

          Veena

              Hello All,
Once again, thanks a lot for all the usefull responses. I have just few questions, can anybody please answer to me.

              1. Regarding Form I-134
              A. In my friends case, in point 3 in I-134 Form, what should i but my friends Martial status: should i put "Married" or "Divorced". My friend is in last leg of divorce, in another 1 or 2 months she will be divorced and getting her final notice. What should i put, what would help in getting the visa with less complication.?
              B. In Relationship to Sponser, should i put it as just Friend, will there by any problem in this with VO, or should i show it as Relative, if i put it as relative, will they ask my friend to prove the relationship?
              C. In point 11, should i put the same text as mentioned in the sample I-134 Form, or should i put something else.

If the above questions are answered, i would send my documents to my friend.

              2. Should my friend approach any visa agencies or she can file of her own itself, which would be the best approach. If she is filing her own, she needs to take the DD, book the appointment date, and go to embassy on the date and take the interview.

I would be really thankfull for each on you for helping my friend out.

Apart from the above, if anybody can share or guide me, it would be really helpfull.

              Thanks
              Best Regards

              Veena.

Do not LIE on immigration forms. If this is only your friend, then put friend... not relative, if she is married at the moment of filing, then put married.

The marital status can be updated before the visa is issued.

She can do it on her own without travel agencies.

                  Hi PraetorianXI,
Thanks again for your help. In point 11, i checked "Intend", should i put the same text mentioned in sample I-134 form or something else, which would be better.
In same I-134, its mentioned as "All expenses including but not limited to their visa expenses, airline return tickets costs to come to USA & US domestic travel, lodging, boarding, food, incidental expenses and visitor medical insurance."
I am going today go get notarized, please advice me on this.

                  Thanks
                  With Regards

                    Any public notary will do.

Just take it to a Bank, they usually have someone who is a notary.

                      Hi PraetorianXI,
Thanks a lot again for your quick reply. As you are saying to everybody that we should show strong ties in india for returning back from usa, in my friends case, can my friend show the divorce notices which the court has given so far, Will these document (notice) can be shown as a supporting ties document.
In general, my feeling is that its very clear that a divorce case is running and she needs to come back to india to attend the court and get the divorce, also the notice shows a strong commitment in india. What are you suggestions on this, please let me know. Will there be any chances of negative thoughts coming from VO.
Based on your recommendations, my friend will start taking the DD in HDFC and book the appointment date.
Also PraetorianXI, can you guide me step by step what to do, after taking the DD (i believe this the first step).

                      Thanks
                      Best Regards

                      Veena
