  • Hi Orion..Sincere thanks & gratitude..One last query

Hi Orion. I sincerely thank you for the promptness in replying back. This is my last query. Please advise:

I have 3 offers from different bodyshoppers. Can I transfer my H1 to all three and later decide which employer I desire to join (just before I travel to US and after verifying the credentials of all 3).

Also there is one body shopper who tells me that I can travel on my earlier employer's visa and they will do the H1 transfer after I reach US. The only document that I would be having from this body shopper is the Offer letter. Will that suffice and also would there be any legal problems at the Port of Entry.

    Thanks & Regards

When you initially apply for an H1 from outside US or when your status is not H1 in the US, then you can apply for as many H1s as you want. But when you enter the US on H1 or change your status to H1 from within US, you have to choose one of the H1s you have.

Transfer of H1 necessarily means that you are working for your employer in US and you intend to change to another emplyer. So you can transfer your H1 only to one employer. If you want to hold multiple offers at a time then you'll have to apply for new and fresh H1s.

Note that there are high chances of you/your employer getting a Request for Evidence (RFE) while transferring since you have been out of US for a while (if I remember your last post correctly).

Also, wait and watch if another senior member of the forum has an opinion to post.
