  • visitor visa for a guy who is seeking K1 visa

    Hi All

I am 38 year divorced Indian guy. I know its a bit difficult to get visitor visa for people like me who do not have strong family ties nor great assets. But, now the situation has changed.

My girlfriend (now fiancee) has filed K1 (I-129F) at the VSC. She is a white american born citizen. Now, do I have chance to get visitor visa. I guess the visitor visa is denied because every visitor is considered to be a potential immigrant. But, they know that sooner than later I would get through the K1 visa and its just a matter of time. So, why would they try to stop me. In fact, if they ask me if I would come back, I'd say I would come back but again go to US on K1 later on for forever ! So, their presumption that I would not return back does not hold any significance now.

So, what are my chances of getting visitor visa ? I am doing this because there is a long line at VSC and it might take 6-8 months and my fiancee wants me to come over and meet there ;-)

any ideas please ? thanks !

When you go for a B1, rules of this class of visa applies. Whats gonna happen about your K1 in months from now does not matter. So the facts will remain the same as you said for your B1 interview. Good luck.

Then it would be a paradox. How and why should I try to prove that I have assets etc. here when I am really planning to be in USA as I filed for K1. When I tell them about it as I don't want to hide, its obvious that sooner than later I want to be in the US. In fact, I would ask my fiancee to send a sponsor letter for the visitor visa.

        Your chances are slim.

You still have to prove non-immigrant intent. And it will be very hard with having a K-1 pending... because for all we know, you could easily stay and marry there without the K-1 visa and apply for AOS. USCIS does not want that, so they will very likely deny your visitor visa.

6-8 months is NOT a LONG time.

Valid point made ! Unless I hide this fact, I will certainly fail the test of visitor visa ! I guess I will rather wait.

Hiding this fact is not a good idea, right ? my siblings live in US and they can sponsor me. What do you say Praetorian ?

Hiding the fact... may get you banned from the USA for LIFE (and say bye bye to your K-1 or any other visa) thanks to LYING to USCIS... so, I would say it is a bad idea.

Just wait for your K-1 visa.
