  • visa or no visa

Hi. I am new and i couldnt find any answer to my woes through the search engine.
    Let me explain my situation:
my boyfriend is an american citizen (40) and i am italian (34) living in Denmark.
We met in Europe in summer 07.
I visited him for 8 days in usa and entered the country without visa under the visa waiver program (aug 23 to sep 01 2007). Then I visited him for 3 months again without visa form nov 2 2007 to jan 27 2008. I was stopped at the port of entry and asked additional questions but i was granted entry.
I have sufficient funds in my bank account (around 50 000 dollars) and i have a job and a rented house here in DK. I am currently on sabbatycal until nov 08.
Neither me or my boyfriend are divorced.
MY problem is , that i would like to see him again from start of april 08 to july 08, which is more that 3months
I would like to apply for a B2 visa in order to have the chance to stay 4 months.
-would i have a problem to obtain a visa, since i have been questioned at the port of entry?
-and what are my chances at the port of entry in your opinion?
I want to play by the rules and have no intentions to lie or have hidden agendas here.
I would like to stay with him a longer time and explore the relationship and compatibility without having to take major steps yet . I have time and funds to do that before we make big decisions.
    what are my odds?
I appreciate any comment or suggestion. Thank you

What is your legal status in DK?

If you can show strong ties to the country where you reside, then you will have good chances of obtaining a tourist visa.

I am a permanenent resident in Denmark. I have been living here for the past 14 years but I kept my italian citizenship. I have my education from DK and i have worked all the time.

You are fine then. Since you have ties to DK, go and apply for your B2 visa.

          just an update.
i was at the interview today at the USA embassy in Denmark.
My visa got rejected. The lady behind the desk saw me only as a single woman with no children. The fact that i have been living in DK for 15 years, have a house, a job to return to and a danish education ( and lots of cash)meant nothing.

She also thought that it was very early to try to get to the States again, since i have been there 3 months from nov to jan. I explained that i didnt intend to leave immediately, but i was aware of some processing time.

Well do you think that my chances will improve if i wait a month more?
My life situation is not going to change in that period of time.
Any suggestion will be highly appreciated

Sorry about your situation, sometimes some consular offices can not see past their own presumptions...

What documents did you bring to prove your ties to DK?

i only had th eletter form my employee about granting my leave of absensce to nov 08 ( she hardly looked at it)
my bank statement from the day before (also that was ignored)
The questions revolved very much about how long i have been living in DK and how long i was separeted.
then she said that it was very hard for me to convince her i wasnt going to stay in the Us.
i m quiet desperate now, because a visa denial now means i cannot use the visawaiver in the future, right?

i have booked a new appointment for april 28th.
I am applying again for a tourist visum and i am asking for only 6 weeks stay max.
What can i possibly do to improve my chances , since i got rejected blank last time.
                thank you

Your job, funds in DM are of no importance because you were denied because of the purpose of your visit.

If your boyfriend is a US citizen, the officer will presume there is every chance you will marry him and not come back.
This is in direct conflict with grant of a visitor visa which requires non-immigrant intent.

Now it is in their computers and everytime you go to apply they will deny you.
UNLESS you wait a long time and apply with a different purpose of visit.

If you do not succeed this time, let him come to you for a decisive visit, because you won't be able to go even on a
                    visa waiver.

What I meant was, he could spend some time with you , instead of you with him ,like you said, to decide if it will work out for you guys. I hope it does, and you could get married in DM if you wished to.
