Hi, I am Indian resident, 30 year old, married, having a daughter 2.6 years old. My sister lives in US, married, having a 8 year old daughter. My sister and her daughter are US Citizens and my brother in law is greencard holder. I need your help as my brother is being diagnosed with
Multiple sclerosis and was also admitted to the hospital for the same. He
used to the only earning hand for the family, but now he is bedridden
completely. Now sister is working to make a living and for child's education as well. She need me to come there so that I can help them as she has to work, she drops her daughter at school but somebody else picks her up and being alone in the house, my brother in law need some attention
as well. She needs me so that I can take care of my brother in law, and he trust me so much and also listens to me more than anybody else. Only I have to go so my wife (Who is a software engineer working with a MNC), and my daughter will be here in India only. My mom went to US few years back, got 6 months visa and stayed for 3 months, at that time my sister was pregnant, that is why she went there.

Can I get the visa on these grounds, that I want to go there to help them out in their time of crisis and provide some moral support as well. I
think I will be staying for 2-3 months only. I can take my brother in law
to the accupuncture treatment which takes place twice a week as now my sister has to take a leave to do so. Moreover, as my brother in law is
also suffering from acute depression, which is a symptom of multiple sclerosis can not be left alone at home all the time, need to have someone right there all the time, because of his condition, he can barely walk, talk, control his bowel or bladder, and even have difficulty eating.
Please help me and guide me through, what papers should I show to the
consulate, what papers does she need to send me or the consulate, I was thinking that she should send a detailed email to the consulate explaining them everything, including the medical reports and the condition of my brother in law.

You would not be able to get visa based on this, as you are essentially
trying to go to US to do the kind of work as nurse, long term care etc.
and trying to take away their jobs. Even though that is not your intention, and you are trying to just help, that is what the officers would think, I
    believe.

      Hi,

I also wanted to know that if she files a petition as she is a US citizen for me in the category of Brothers and Sisters of US Citizen for permanent residency or immigrant visa, how much time does it take, does this vary if she files a petition from here as somebody told me that waiting period is less if one applies from India, but I think the petition needs to be filed at the USCIS centers in US only, please advice.

      I really need your help.

Application from India is no longer allowed. (When it was allowed, it was only for spouse, not for brother/sister.)

        It takes around 12 years.

          Hi,

Thanks for your reply, I was thinking that I should say my brother in law is suffering from Multiple sclerosis diagnosed recently (Ihave all the hospital reports) and now he is completely bed ridden and he wishes to see me that is why I want to go.

I have explained my whole situation here but dont know what should I say which can grant me a visa or increases my chance of getting a visa. I was thinking that I cannot show that I want to go for tourism as they will say why your wife and daughter are not accompanying you then. They really need some help and they are not financially very sound at this time, so I am not sure that they can provide Affidavit of Support, I dont have good bank balance as well.

Please suggest something, we are very worried about them. Please help me out.

          Regards,

It would be very tough for you to get visa in such a case.

Can we, my wife and my daughter go for a visitor visa for vaccation
Can my wife be the principal applicant, as she has strong papers regarding pay package, IT returns, bank balance etc. IF YES, WHAT DOCUMENTS SHOULD WE TAKE TO SHOW THAT WE ARE VERY WELL SETTLED HERE, like how much bank balance, what papers for properties (Their registries or CA evaluation) SO THAT THEY CANNOT POINT OUT THAT YOU WILL NOT COME BACK,as we really dont have any intention to stay there at all.
Is there any chance of getting visa if we book a holiday package from Thomas Cook or SOTC for US like LV, Orlando, etc.

Please advise, really need your help.

                    1. Yes, you can try for visitors visa. Details at https://www.immihelp.com/usa-visas/visitor
                    2. Booking a holiday package does not increase your chances.
