Hi,
Here is my history:
F1 -> H1. Came back to India before 3 year validity expired. (no rejections ever).
Husband Greencard -> citizenship -> back to india
Daughter -> Indian born US citizen.
Technically, I am eligible to apply for a greencard. Last time I went to get my H1 stamped, the VO asked me why H1 when you can get a greencard. At that time, we were not sure whether we were going to come back to India. So I told him I will apply once I go back. He entered something in the computer and agreed its better to apply in the US.
After that, we decided to go back to India for good. Now I may visit my SIL for about 10 days. Which means I will need a visitor visa.
Questions:
1. will it affect my chances of getting a visa (given the fact that I am eligible for a GC and not applying out of choice).
2. Am I better off sponsering myself (I work in a software company) or should I ask my sis-in-law (also a US citizen) to sponser me.
Thanks,
Ketaki
