  • B2 Rejected for In-Laws

    Hi,

Yesterday B2 Visa was rejected for my Mother-In-Law and Brother-In-Law with 214(B) reason. My Mother-In-Law is a government employee with NOC from her office and my brother-in-law has just finished his 10th exam (16 yrs of age) We think we got the rejection because of the status of my brother-in-law as he can be a potential immegrant.

What are the chances that if we apply only for my Mother-In-Law's visa ONLY and she gets it. My Father-In-Law has his business and he can not come to US.

Each B2 applicant qualifies on their own by proving their non-immigrant intent. If something in terms of the ties to the home country has changed since the last rejection, she can attend again. Carry proof of business, employer approval of leave etc with property and ties. The fact that a son will be in India and attending college (BIL) will be an added advantage to prove that she has to return back to India and strong ties.

Best thing is to wait for few months and reapply just for her alone.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

You guessed it right yourself. I would think if your MIL applied all alone without your BIL tagging along with her, she had a good chance to get approved as your FIL would be a strong tie for her since he cant do due to his business constraint.
