I-94 was given for only 3 months for a visitor visa

    Hi All,

    My mother has a multiple entry visitor visa for 10 years. She came to US on Dec/10/2007 and went back to India on Feb/19/2008 because of an emergency(I-94 was given for 6 months, Class B2). She again came to US on Apr/01/08(after 41 days) and this time she got the I-94(class B1) only for 3 months(expires on Jun/30/2008). Please let me know if there is anyway she can extend it to 6 months instead of 3 months(She was supposed to get 6 months but she got only 3 months and she never voilated any immigration laws).

    You're/She's lucky ...

    ... and there's no such thing as supposed to get six months.

    It appears that she's trying to live here rather than just visit.

    She's lucky to get three months, else in such a scenario they'll give only a couple of weeks with a warning to use the visa for the purpose it's given.

      She was out of the country for 41 DAYS and you expect her to get approval for a 6 MONTH visit. She is lucky not to have received only a month and a warning. Attempting to extend her stay will likely be denied.

      She should return home according to her I 94 and not try to visit again for quite a while. She can lose the priviledge of visiting if it appears she is trying to live here. Trying to spend too much time in the US is violating immigration law.

      Entry into the US is never guaranteed. No one is "supposed" to get anything.

        You should be glad they let her in for 3 months. People have been given a warning with 30 days for similar cases. Visitor visa could be cancelled for frequent visits and you need to be careful.
