Urgent help please!! Can NZ citizen sponsor father from India to USA??

Hello Friends,

Need some advice to sponsor my father to USA on visitor visa.

I am a New Zealand citizen (Indian Born) and have PIO card, still did not apply for dual citizenship.

Now i am in USA , my status is I-485 in process have the EAD and working .

My question is can i sponsor my father to USA from India?
Do i need to send the New Zealand passport copies as part of the sponsor documents ( as proof of birth certificate) or should i send the original birth certificate ( which is from India, i am born in India).?

You can not send an I-134 for him until you have a defined (not pending) legal status in the USA.

Isn't I-485 a valid legal status? I am sure it is. In that, case why can't he send the proof of his I-485 filing like a receipt?

I am not trying to confront you. Just curious to know your reasoning.

I am talking about what his status in the USA was before filing I-485. Such as H1B/L1/F1 some kind of status...

So , you mean i cant sponsor my father till my GC is issued?
My previous status was H1B,that H1 B is still valid till 30th sep 2008 but it is with former employer, my GC processing is done with another company,for whom i am working now, where my I-485 is in process .

Common misconception is visitor needs a sponsor. A visitor need not have a sponsor for a visit if they can qualify on their own. Infact, the sponsor letters only are part of the equation for a visitor visa.

A rich businessman wanting to tour US can apply for a visitor visa on his own and get approved.

As long as your father has a predefined Itinerary of places they are going to visit or stay with, he can apply for a visitor visa. Whether he gets it or not depends on how well he can prove his ties to the home country and can get over the presumed immigrant intent by the VO.
