  • Applying for EAD while on Visiting Visa.

    Hi,
Can yu please advice me on applying for EAD whilst on Visiting Visa[B1/B2].

Can I apply for it in the US once I get an employer whilst on Visiting Visa? If yes..how much is the waiting time and can I take on work as I am waiting for EAD?

    Thanks...

What is your basis for applying for EAD? You just cannot apply EAD without a status that allows work and expect USCIS to grant you one.

No work is allowed on visitor visas.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

Not on visitor visa. You need a different kind of visa to work. May be finding an employer to sponsor might help.

You may not work on a visitor visa.

You say that you are licensed to practice PT in Michigan; if you had obtained a license, you should be well aware of the rules and regulations for practicing PT in the US, and thus I find this question to be very odd.

You need to review both the laws regulating the practice of PT in Michigan and also the US immigration rules. You may need to renew you license or do something along that manner before you apply for employment. If any testing is involved, you need to identify that before you enter the country and enter in the proper status.

Also, you know that a visitors visa requires that you intend to return to your home country. Entering on a visitor visa with the intent to remain may cause you to be denied entry and/or to have your visa revoked.
