    Hi,

    It will be nice if anyone can suggest me on my situation.

    My I-94 expired in October 2007, my employer already applied for renewal of H1 in May 2007 but the status still shows as "case received and pending", my employer is following up with USCIS for it. As per rule I cannot work after 240 days which will be in last June.

    I got my EAD and 485 is pending, can I sponsor my parents on the basis of EAD ?
    It will be very helpful if you can provide information on the same.

    If you are working on EAD, you are a parolee and that does not disqualify one from sponsoring a visitor.

      Thank you so much for your reply.

      Though I got my EAD few months back (valid till 2008 year end), but never used it as I was having H1B (though renewal status pending).

      It will be very helpful if you can let me know the following :
      My H1B renewal status is pending and 240 days will be completed by June 2008 end.

      a) Can I simply send EAD card and H1B renewal receipt for sponsoring parents.
      b) Do we need to fill any form if we use EAD.
      c) Will my H1 status will be invalid if I start using EAD.

        a. Yes. Send I485 receipt also. None of these are ussually checked. They might ask in the interview.
        b. Did you mean at the employer? Yes, fill out a new I-9.
        c. Yes. You are no longer on H1b. H1b, if approved remains valid. But you are not on H1b status until you return on a H1b.
