    I am inviting my elder sister who is married and has a son, but she plans to travel alone as my b-in-law has to take care of his old mother and property, she has her interview in 2nd week of august.My husband is sponsoring for her visa.My husband is a GC holder and i came on B2 visa and got converted to H1.We have a 9 months old whose first birthday would be in nov 2008.I have mentioned in DS156 form the duration of stay as 2 months and her tentative date of travel as sept12.

    Do i mention in the invitation letter as

    "We would like to invite you to the United States of America to stay with us for about two months. We would also be celebrating our daughter's first year birthday on November Xth 2008 and would love your attendance for the same"

    OR

    DO NOT mention "We would also be celebrating our daughter's first year birthday on November Xth 2008 and would love your attendance for the same"


    Does it be any better to increase the chances of she getting visa or convinced by the VO if we are also mentioning about our daughter's 1st bday in the invitation letter to my sister.

    Though i have just mentioned "TOURISM and FAMILY VISIT" for travel purpose in DS156.

    The ties to home country matter the most for a visitor and you mentioning about the B'day will not have any positive or negative impact on the visa.

      Documents required for sister's visa

      Thanks for the response.

      Since my sister is travelling alone, can someone please tell me what other additional/supporting documents can she produce to prove her strong ties.She has her interview in kannada during aug 2 nd week.


      My sister lives in a joint family, she would be taking pictures of her joint family including her husband and son, her son's birth certificate and his school ID card, ration card, original property papers of the land, tax papers of their house,bank statement.But no land papers/house is registered under her name, it all belongs to her father-in-law, and she would take hierarchical property paper.My sister has travelled before to Singapore last year to visit another sister of hers.Her education is just 7th standard and she cant speak english.My parents live in India, and she has a brother who is working and also lives in india with parents.She plans to visit me in the US and i have never been to India in past 3 years since my first visit to US, as i have married a greencard holder and came initially on tourist visa and currently on H1.

      Any inputs or feedback or advice based on her case from anyone is appreciated

        As long as it does not come across to the VO as if she is coming here to babysit your young baby, she will be fine.

          No i am also currently not working. I had written another thread on my situation under H1 visa category :

          and based on the advice from immihelp i consulted another immigration attorney and he said as far as me inviting anyone on visitors visa with my husband sponsoring it should be fine irrespective of my out of status and can say i am working currently as they dont ask for my pay slips since i am not the sponsorer, also my H1 is currently not cancelled by my employer and they are willing to hire me back, only thing is i wont be able to reenter US if i leave the country before i get my GC after my husband gets his citizenship. So i very much want to try for my sisters visa or someone back from my home in india to help me out with my young baby as well as i want to see them as its been 3 1/2 yrs since i last visited my family back home.

          Please let me know if my sister needs to produce any other documents that would help her.

          Also if asked by VO about my current visa she would say H1, if asked is i am working shewould say yes, and if asked what visa i entered US she wud say B2.She would tell everything as it is except if asked whether i am currently working she would say yes, else i know it would cause an issue.

            Not working and getting paid on H1b status will cause bigger issues to you than your sister's visitor visa. You need to get paid all the time while on H1b visa.

            I asked about your work just to see if the VO can interpret it as a babysitting situation and babysitting on visitor visa is illegal.

              Duration of stay in DS156 for sister's visa

              I have mentioned 2 months in DS 156 form for intended duration of stay for my sisters' visa.Since i am inviting my married sister who plans to travel alone, stating for tourism and family visit purpose would it be better to mention "1 month" instead of "2 months" for duration of stay. Because i understand for parents or in-laws it makes sense mentioning 2 months or more since they would generally stay back for more number of months with their children. But since my sister is not travelling with her husband and that both me and my husband are working and we have our 9 month old, will mentioning 2 months for my sister give the VO an impression that she is coming for baby sitting?Does "1 month" or "2 months" make any difference?please let me know your inputs
