  • Members - Need your inputs on how to apply for a second time for a Visitors Visa

    Hi All,

Thanks to all for responding to my earlier Post. This time Need your inputs on what can we do differently to apply for a Visitors Visa for my Parents in law a second time since they were denied visa the first time under section 214 b. The reason for denial - The VO asked him if he had applied for a US visa before , he answered "NO", however He had applied for a visitors visa a couple of years ago which was rejected because he overstated the time of stay in the US. The agent who was helped him fill the form advised him to say a NO since his passport was not stamped with a reject the last time he applied.

The visa rejection letter stated that they could try for a second time.

We are expecting a baby this year and we really need my wife's parents for support, because we have a high risk pregnancy. Any inputs ??

    Thanks,
    JK.

Your father-in-law lied in order to try to obtain a visa. Visa applicants are tracked by computer not by passport stamp. The fact the person assisting him in completing the paperwork advised him to do so is of no concerned to USCIS. He signed the application stating everything was true. He is lucky that he was not issed a permanent ban and was told that he could apply again.

The birth of a child is not considered a reason to issue a visitor visa. If you need assistance, you should plan on hiring a housekeeper, nanny, doula or nurse to assist you. If this is not possible or you and your wife feel that she must have her parents to assist you, make immediate plans to return to their home.
