    hi all,

    i just found out about this website & i badly want some information . . My sister is back in india & she is very sick with a severe fracture. she cannot trvael to the US Alone . my parents just went back from the Us to India this june 2008! now my siter really wants to bring them back . they have a visitor visa for 10 years & they also went back to India last time by the date stamped on thier i-94. will there be any problems to bring thme back by october 2008? please help

    Depends on the POE officer. Visitors have to spend more time in home country than US. How many months did they spend?

        Does she not have med-evac insurance?

        Coming to US to care for her would be not in keeping with the purpose of a visitor visa. She should expect to hire a nurse.

          My Parents stayed in the US from jan 2008-june2008 . so they have stayed in INdia for 4 months now!!!

              Did she not purchase travel insurance with medical evacuation coverage? That is a very important thing - as you and she have now learned. Have her check her regular health insurance plan to see what benefit it offers - if any - for her return to the US via air ambulance since she cannot travel alone.

              There is also the medical issue of her traveling with a fracture. The airline may require medical clearance. Healthwise it may be dangerous for her to take an extended flight. Given the circumstances, I am certain an attorney can postpone the naturalization process until she is fit to fly safely.

              She does not need two people to accompany her on the return trip. I believe that one parent is less likely to have an issue with the IO than both. If both appear when she is returning for the naturalization process, the natural assumption is that your parents are returning and will be filing an AOS to a GC as soon as she takes the oath. They can be denied entry for this reason.
