H4 visa expired

Hello friends,
My employer forgot to apply for H4 extension for my family, i realized after 5 months of overstay,now they are leaving for stamping to INDIA, to get stamped and return to US.My H1 got extended,but is there a chance to get H4 rejected??Please help if anybody gone thru this case or know the issue.

If it is past 180 days, it results in a 3 year ban. They have two choices.

Nun Pro Tunc - Now for Then (google for it)

Leave and return with a stamp and clearly mention it in DS156. Take a letter from the lawyer/company that they messed up.

There is a chance for H4 to get denied but VOs may be considerate.
