  • H1b might get rejected..... visitor visa question

    I have worked in the US for abt 3 years now, but having visa issues when i came back for a holiday to Indonesia.

    Anyways, my company gave me a deadline of October 31st to get back there. In the case where I cannot get my visa by then, can I apply for a visitor visa to settle my personal stuff back in the US? Personal stuff includes selling my personal belongings, my cars, moving out of the apartment, closing my bank accounts, etc. If I can apply, should I just tell the interviewer that this is the purpose of my visit? thanks.

    nobody has experience with this? i tried searching the forum and reading thru the FAQ, but nothing pops out...... pls help

      Do you know the reason for the delay?

      You can always try for a visitor visa. Certainly tell the truth. Ask for enough time to settle your affairs.

      You can also have pa power of attorney notorized to a trusted friend. The consulate should have a person able to do the acceptable notary stanping. A POA gives that person the right to act on your behalf in doing these things for you.

        i have no idea why it's taking so long.. apparent, my h1b waiver application was sent to the US for processing...

          If H1b is needing a clearance, any type of visa issuance for you will involve the same security clearance.

          I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

              i have a couple more questions to ask.... to show them my intention to come back to my home country after clearing up all my issues in the US, wat can i really show them? only thing i can think of is a letter of employment.... my bank statements and all my other stuff r in the US... my parents live in indonesia, but is that enough?

                  i just emailed the embassy abt supporting documents I need to apply for a tourist visa, and this counselor that I have been communicating with lately replied me stating that I cannot get a tourist visa because my H1-b visa was rejected. Is this for real?? From what I have read, each application should be treated separately no? I just want to go back and settle all my personal stuff like moving out of my apartment, selling my cars and etc... this is BS

                    If the rejection was a reason where any visa could not be approved, then that is pretty much it.

                    For example, a CIMT would result in rejection for any visa.

                      If you cannot return to the US, you need to get a notorized power of attorney giving authority to a trusted friend or relative to do these things for you. You can download samples off of the internet and have it notorized at the consulate.
