Expiring Visa

Hi,

I came to the US on the 23rd of April 2008 and it expires on the 23rd of October 2008. I have 5 years multiple visa. I have sent the I539 application requesting for change/extension visa in September. My I94 was attached to my passport so they have removed it and they sent the passport back to me saying the case is been handled. But my visit expires on the 23rd now, So what should I do? Should I stay or leave?

Are you saying you sent the original passport and original I-94 with the extension aplication?

Yes...cause I had the I94 stapled to my passport..

I don't understand why did you send your passport and I-94? You don't need to send any originals.

Looks like your application was returned to you unprocessed.
