  • I-94 Stamping

Hi, My mother is here on B2 visa. When she entered in July at port of entry her I-94 stamped to Dec 2009 instead of Dec 2008.
The officials didn't ask her how long she want to stay but he was joking with her that he knows she wants 6 months. But instead he stamped for 1 and half year. Intially she planned to leave in November that will be 5 months stay but I want her to leave in the first week of Jan 2009 after my daughter 4th Birthday. Will it be a issue. Do we have to file for extension.

    RE:stamping

I think the officer made a mistake, it should be January of 2009 if your mom entered on July 2008. Do the math and count 6 months, your mom should leave within the 6 months, say if she entered July 15, then book a flight before January 15. - just my thoughts.

For visitor visas the MOST allowed is 1 year (though in most cases visitors are only given 3-6 months).

So the above tells you this is a mistake... you need to have her leave before 180 days since she arrived.

Do not risk her visa. She could lose it for "ASSuming".
