  • Over stayed by 2 years! HELP!

    I have over stayed my tourist visa by 2 years.
    and I need to leave the country, but want to come back..
    I wont go into details why I over stayed.. it just happend.. once I passed the 4 month mark and was an over stayer, I thought well im over now so be it..

    but I really shot myself in the foot, now I hear things like I can be banned from entering the country for like 10 years or something.. is this true?

    what can I do?

    will I have any problems leaving the airport?
    will I be arrested at the airport? forcefully deported?
    will I have fines to pay?

    or will I have no problems leaving, and just be denied entry next time I come back to the us?

    any help will be much appreciated..

    if I change my passport, does this help leaving in any way?
    I know it doesnt help coming in as its all computerized and finger printed..

    You should not run into any problems at the airport.

    Your visa is void. You will have to wait 10 years before coming back to the USA will have to apply for a new visa.

    Do not try to fool the system by changing passports... you have to reapply for a visa, you can not use the same visa and if you are caught lying for immigration purposes you will be banned for life.

    Is there no integrity out there any more?>

      I c... what do you mean by apply for a new visa?
      I never applied for the first one, I just arrived and was given 3 months when I arrived at LAX...

      being banned for 10 years. oh no... never thought it was this serious..

      so there is nothing my embassy can do?
      I cant pay a fine and have my charged dropped?

        Any overstay more than one year bars you to reenter for 10 years on any visa. If you wish to settle in the US, the only sure way to avoid the bar is to marry a US citizen while in the US, if you are single.

        If you do not wish to settle in US , and if you leave now, you won'e be able to reenter for the next 10 years. Even after that you may not get another visa because you overstayed.

        Still, talk to a good immigration attorney before you leave US, there may be waivers available for the 10 year bar.

          So you entered under the Visa Waiver Program... well, either way NOW, you will have to apply for a tourist visa if you wish to come back... and you are subject to the 10 year bar.

          The only waiver would be an i-601 waiver, and those are not easily granted... specially in this case.
