  • Help Needed - visitor visa for parents rejected due to age difference

    Hi,

my parents visitor visa application got rejected, because there is very less age difference between my mother's age and mine (About 10 years). My mother did not gave much attention to date of birth when she applied for passport (I think she does not even know exact year..).. I noticed it when applying for visa, but did not know what to do... As feared, her visa got rejected precisely due to this.

Please advice what can I do?

    Thanks in advance.

Get it corrected in the passport! You need to atleast provide a sensible estimate of the dob, how can the current one be true by any chance?

Just curious, how do you know it was rejected for that precise reason and that it was not some other reason of denial?

      Thanks for reply Orion.

She mentioned this to me yesterday. I will get more info on this tomorrow.

Actually I found out about this mess while preparing docs for her visa, but it was already late so took a chance.

        Hi Orion,

        Sorry, could not reply earlier.

She was asked only 2-3 question.

        1. How could he be your son, when then is not sufficient age difference?
==> She said that she doesn't know her correct date of birth and agent created a affidavit for her.

        2. What visa your son currently holding.
==> She mentioned its work visa.

        3. What work visa.
==> She just said its work visa and I don't know the type. (Although she presented petition etc).

Consular said no i can not grant you visa and denied under section 214(b).

I understand that date of birth of my mom doesn't make sense (when compared to my date of birth), but unfortunately that's the way it is.

My parents have checked to see if it can be changed in passport, but that seems extremely difficult for 2 reason.
        1. She did not have birth proof, so she submitted affidavit about her age. Now how can she challenge her own affidavit?
        2. Date of birth in passport can only be changed by court order. She need to provide sufficient proof for new date of birth and reason for wrong affidavit.

I am in US while my parents are in India and I understand that it was a gross negligence, which has landed us in this situation.

Looks like changing date of birth in passport is not possible.

If she applies again (with some more interview preparation), what are her chance to get visa?

        Thank you,
        -Abhay

I would strongly recommend to get it corrected in the passport somehow as this issue might pop up again. I am sure your mom visually doesnt seem like the age mentioned in the passport. Another affidavit can be filed negating the first one.
