    My parents (Father (67), mother (57) ) attended the interview for visitor visa at Mumbai Consulate yestr and their visa applications were rejected under 214(b)..ie potential immigrant etc. But my parents were asked just two questions

    1. How many children do you have?
    My father's reply :2 sons (elder in mumbai and younger in US)
    2. Does your son have a green card?
    My father's reply: Applied for green card and is currently on EAD. (My H1b visa expired Oct 2003 last year and i'm no longer on H1B since i got my EAD on April 2003.My father took out the 485,EAD,AP,140 documents but the officer said she does not want to look at any documents)

    My father showed the affidavit of support (I-134) in which she circled my company's name with red ink(#7 employed as ...with...) and said based on the current economic situation we cant issue you a visa right now. In I-134 i have specified my status as AOS with my A#.

    I'm planing to apply for the second time but before that i would like to first interpret their actual reason for rejection and prepare accordingly. The rejection leter said its due to 214(b) but thats not the case. I would like to know the following

    1. Can we conclude that the rejection is bcoz i dont have a green card right now and is it advisable to apply for tourist visa only after i get my green card? Any similar rejections based on pending AOS criteria?

    2. What do they mean by economic conditions?Obviously its not my father's economic situation bcoz they didnt see any of those property/pension documents. Also i earn a decent salary and have enough bank balance.

    3. Any other thoughts/ideas that you might think will be helpful for our second attempt?

    1. It is not necessary for you to have Greencard to sponsor parents' visitor visa.

    2. I have no idea what exactly they are thinking. But if they circled your employer name with red ink, think about it. Do you work for any employer which could potentially be troublesome. Think of what the reason could be.

      Hi,

      Thanks for your response.

      I have some more questions.

      1. On the day of interview, at the counter where tokens are collected, my parents were asked for the passport, I 134 and invitation letter. No other documents were accepted. Is it possible to attach all the documents and submit at the counter so that it at least gets to the interviewing officer and ensure that the officer has all the attached documents in hand during the interview?

      2. Any previous experiences on what documents are submitted at the counter and what documents/papers does the interviewing officer hold or have in hand during the interview.

      3. Should we wait for interviewing officer to ask for the documents, if they dont accept it initially or should we should produce it to the officer upfront as soon as the number is called and before the interview starts.

      4. Does the I -134 needs to be notarized by an immigration lawyer or lawyer or any eligible notary.

      5. Is it possible to take a interpreter the second time?

      6. Based on past experiences, any idea's on how to present the documents to the officer in case the officer is reluctant to see/accept any documents.

        1 to 3. Just give whatever they ask for. If you are asked a question, if you think some document would help prove something, give supporting doc.

        4. Notarized by any notary.

        5. Yes.

        6. If officer does not want to see, there is nothing you can do.
