B2 visa after H1B visa

I need some input. I wanted to know if I am eligible to apply for a tourist visa to the US.

Here's my situation.
I was on an H1B (6 yrs + 1 yr OPT). It expired on Dec 1, 2008. In the meantime I enrolled in School and had an application under review for change of status from H1B to F1. I consequently withdrew from classes on 01/13/2009 and left the US on 01/23/2009 and now I am back in India.
I had also applied for a Canadian Permanent residency in the meantime which is currently under review.

My question - Could I apply for a US tourist visa after this? If I am called for the interview to the Canadian Consulate, it is going to be held at the Buffalo, NY location. I hope I don't have to...

H1B Visa Stamp V/s Visiting Visa

I need help in similar issue..Can any one please help?

My sister is having H1B visa (I-94) starting from 0ct -2008 to OCT 2012. But she did not come to USA after she got H1B stamped.

My sister needs (personal reasons) to visit USA this May. She is planning to go for visiting visa (Chances of getting visa are high). But I have few questions before we go for visiting visa.

1.Is it possible to apply for visiting visa while having H1B visa stamp in the same time period? Can we maintain two visa's (H1B and Visiting Visa) in the same time period?

2. If they approve visiting visa will they cancel the H1B I-94 at the port of entry or while giving visiting visa stamping?

3. Can we change status from Visiting Visa to H1B with in USA or do we have to go out side of USA (Canada or India) and change visa?

Bottom line we don’t want to risk H1B visa FOR ANY REASON. Open to all suggestions.

Please note that my H1B visa expired on 1 Dec 2008 and I left US on 23 Jan 2009.
