  • How to convince consular office about non-immigrant intent- Chennai Consulate.

My mom’s visitor visa got denied 2 years back in Chennai consulate (on 214 ground). My mom is 70 year old and single. She is living with my sister family and drawing government pension to support her. She has her own house. This is the only commitment she has in India. I am only son of her; I am in US having GC. This was the fact that we presented in 2006. In interview, they asked only one question about our family. Then they refused the visa on the spot. They did not give any reason in word. My mom asked the translator, why they are refusing. The translator told my mom that the reason may be consular officer feels that the dengue fever was spreading in Chennai in 2006, so they were restricting the number of tourists from Chennai. However, I strongly assume that consular officer determined that time that she does not have enough commitment in India to return back.

Now I want to apply her visa again. Her family status and commitment in India does not change since 2006.

Now my big question is how to convince consular office about her non-immigrant intent. What document I should give her to convince the consular officer. Is there any other approach (or seeking travel agency) will help?

Even if consular officer gives my mom GC on spot and ask her to stay permanently in US, she wont stay in US not more than 6 months (becuse of cold whether and lack of social life etc..). My mom is reluctant to go to Chennai from my home town in hot summer months and to stand in que for several hours and getting denied. Because of this hurdles, she is not interested to go to consulate.

Now my big question is how we should approch this time differently, to maximize the chance of getting visa. Is letter from Senator/Congressman help? Any succcess stories from chenni consulate from sililar situation folks, help us.

    Thanks

Hi , My parent-in-laws B2 visa was rejected in MArch. What happened that time was VO just did not ask much questions. We had taken Marathi traslater in Mumbai consulate as we thought it would be easy for them to understand the question and explain the things. He asked what do they do, my father -in-lar is retired and mother-in-law is teacher. They asked for their income and just rejected visa. They did not bother to check any documents / ask more questions. Just rejected .............

After some research we understood that if u take translator then VO dont bother to ask u much questions.. they must be feeling why to ask translator then he would talk back and forth with VO and my in-laws.
We dont get change to talk to VO directly and VO also kind of hesitate to ask questions.

This time we did not take translator , we decided that even if there is some accent issue, my in-laws would ask to repeat question. They know basic english anyway.

We reduce the US stay period from 6 months to 3 months in visa form.
Then kept all the docs same. We had all the docs initially as well as mentioned on this website but none of the docs were asked for 1st time when visa was rejected.

This time visa officer asked question like who is in US, what is your occupation, how many months u want to stay.. my in-laws answered the question. They also told that we have all the docs like invitation letter, letter to consulate, i-134 and everything.

VO did not check any document but granted visa ...

    We are very happy now.

So all those people whose parents B2 visa's is rejetced. please try this option, of not taking translator unless absolutely necessary. This helped us, atleast thats what we think.

Translator or not translator does not make a difference.
