Visitor visa and no I-797 approval as of now

Hi

I am planning to sponsor my mother for a tourist visa this month but my H1 extension is still pending. So, as of now, I don't have a valid document to show my status in US. Is attaching a copy of I-797 a must? Has anyone applied with out that and got the tourist visa approved?
