    Hi, Im Irish and I got married to my US citizen fiancee last week In the United States. I am on a B-2 visa and I am pregnant. We plan on going back to Ireland for about 3 months to give birth to the baby in December. Then we plan on coming back to the US when the baby's passport is sorted out, around March 2010. Will I have problems getting back into the US in March even though I am married? Is there anything I can do to make sure I am not refused entry to the States in March 2010? Will I be allowed in on my B-2 visa as it is valid until March 2011?

    You need to read up on how immigration works dear...

    You marrying a US Citizen does not give you any rights to re-enter the USA as you please.

    Once you have established your immigration intent (as marrying an USC) you will have a hard time using a visitor visa to enter. You guys need to file for a green card for you and it looks like you are going to need a lawyer to help you guys figure all of this out.

    Sounds like you need to go through Consular Processing instead of Adjustment of Status and will have to stay in Ireland until it is approved.

    I repeat, once you leave the USA, you will not be able to re-enter as a visitor. You are not a visitor anymore, you are an alien who wants to immigrate.
