My parents 10 year visitor Visa will be expiring in July 2010. They have visited US 4-5 times. Can they go for Visa renewal now in Dec 2009? They are planning a trip to US in Jan 2010. Can they renew Visa from here or do they have to go back to India and renew it? This time when they visit US, they want to stay for more that 6 months by applying extension.

There is no renewal of visitor visas. They have to apply for a new visa, go through the whole application process and interview. And yes, they can do that in Dec 2009.

They have to apply for the new visa from their home country.
This time when they visit US, they want to stay for more that 6 months by applying extension.
Then they better get a new visa before they leave India. It is interesting though that extensions are supposed to be for emergencies and here they/you have already decided (even before they leave India) that that they are going to apply for an extension and spend more than 6 months here.Last edited by smohanty; 12-03-2009, 09:54 PM.

active u.s. visa
hi my grandfather has a u.s. visa now that will expire by july 2010, is his u.s. visa going to be cancelled(the visa exp.july 2010), if he will do an early application?,because he has to attend a wedding by dec 2010.

They can apply for the visa anytime. If they overstay their I-94 even if an extension is filed, their visa will be voided unless the extension is approved (which is very very rare).

Visa is not canceled it just expires. Every time one just applies for a new visa, there is no such thing as renewal. So if he wishes to enter the US after visa expiry he will have to apply again.This is my opinion and not legal advice.
