My husband recently applied for and was granted a ten year visa for entry to USA for holiday as he had a conviction. We have been to USA before and never declared that he had a conviction and he didn't have a visa, just normal passport. This time he applied to embassy for a visa just in case he was refused entry on arrival as he has a conviction. Even though he has a visa now, the form that we fill in on the plane prior to arrival will again ask if he has any convictions, as he has already declared them to immigration at london embassy and was granted a visa anyway, does this mean that immigration at usa airport will notice by his stamped passport that he has been to usa before without a visa and never declared that he had a conviction at that time, will they refuse him entry because he didn't declare in the past?? He is worried that they may do so!

Non immigrant visa waiver form
Here is a link to the document that I presume you have to fill in on plane prior to landing visa document it does say at top it is for anybody not having a visa and requesting visa waiver, as my husband has a visa, will he not have to fill in this form?
