applying for my mom and dad

Hi My husband got H1 visa 3 months back. I want my mom and dad to come here.
1. is it necessary to get a marriage certificate for them??
2. My brother is in Japan rightnow. Is it difficult to get US visa if both of their children is in abroad??
Pls give some advice. Thanks
