  • B1/B2 visa of Kids ( Invites parents)

    Hi. I m new here. My brother( husband & wife 10 year multi visa & they also traveled to USA twice) applied kids visa (drop box)and the visa officer invited to parents to appear in high commission ,brother did not go to High commission because sometimes visa officers cancelled the parents visa too, now someone give me idea that they can applied USA visa from Canada ( all family has Canada 10 year visa ) & if the visa officer ask that why you don’t go to high commission they invite you ? What will be the good answer to satisfy the officer
    that I was scared about visa cancelled Or what ?

    Better to have them visit the high commission in person & ask them not to carry their original passports (can say that passport is submitted for some other country visa application etc) & carry just color photo copies of all pages of passport.

      Thanks, but now brother is going to Canada (second time )with family and applying USA B1/B2 visa in Canada can you please tell what will be the answer of brother? If Consular ask that why you don’t appear in USA high commission in India ? Please help me ( he can say that I was busy that time )
      secondly question
      what he will fill in the DS160 of kids
      that the kids visa is refused or not decided ?
      actully they requested to appear brother for interview not make any decision,but he didn’t go.

        What they’re trying to do is futile. Everything is in the Consular Lookout and Support System Database (CLASS). https://www.state.gov/documents/organization/242321.pdf. They cannot outsmart the US government by changing application location. They will be recognized and their visas will be voided if they cannot address the issue why they were invited by the consular officer in your country.

        Did they break some immigration laws in the USA? Did they give birth in the USA? Did they make use of public assistance in the USA? If they did they are in trouble, if they didn’t they might be okay. What country are they from?

          Thanks , they are didn’t anything wrong in USA , but little bit secare ( some times they cancelled parents visa too)that why high commission requested to appear in high commission in kids visa application.

            Well, first of all, it was a great mistake that parents did not appear at the US Embassy in India. BTW, who told you that consular officer would cancel parents visa? Usually kids below 14 years are exempted from visa interview. However, as they applied through drop-box, some applicants may called for interview in random basis and it was very likely to get the visa approved but unfortunately they lost their merit of applications. To let you know that any US consulate around the globe can re-call the file from their system. However, my opinion is, it would be very difficult to get the visa from other than their primary residence US Embassy. I am wondering their applications are still pending under Sec. 221(g). Better re-schedule appointment & confront the Embassy in India. Carrying visa photocopy does not mean that they cannot cancel your visa without having passport, they have the control number or even they can cancel visa any time without physical presence of passport because they have D-160 filled up form in their system, so always carry passport with you.

            Secondly, you have mentioned that they have 10 years multiple entry Canadian visa and I am assuming that these are TRV (Tourist visa). Normally long term visa holder like student visa, work visa holder can apply from their residence country, however, TRV (regardless of validity) holder can apply for US visa from any consulate other than their primary residence country but it is very unlikely to get approved the visa, therefore, I would strongly recommend NOT to apply from Canada as the chance of getting visa approval is very minimal. Hope this info would help you.

              Thanks for information, but sometimes things go against you & sometimes go in favor of you it’s depends on your luck.the Americans Consular in India even did not see paperwork,

                  No one can guarantee you that a visa will be issued and it is applicable not only for US but also for any other countries of the world. However, it is not necessary that the consular officer would ask you to see the docs all the time, so do not blame a country specific Embassy, most of the time they ask questions from the info provided in DS-160. Keep in mind that it is sole discretion of the consular officer whether s/he would issue the visa or not. I am wondering that you are very confused and afraid of confront the consular officer which is ofcourse against getting visa to be approved.
