  • B2 rejected

    Hi,
My parents and brother appeared for interview last week and my parents got 10 yrs visa but my brother's visa was rejected under 214B stating family ties in India are not strong.

I am on F1 visa and im inviting them for my graduation. My dad will sponsor my brother.

He is an engineering student in his 2nd year and has his exams in june-july 2010. Hence he is planning to return in may end.
He still has 2 more years to graduate.

    VO asked the following Qs:

    VO: What do u do?
A: I am a 2nd year engineering student studying zzz course.

VO: Why are u goin to US?
A: to attend my sisters graduation. I have my exams and will come back soon after the graduation.

VO: do u have any property?
A: No i am a student and i dnt have any property. My parents take care of me.

    VO: Are you working?
A: No. i am a student and im still studying and have 2 more years to complete.

    Visa rejected under 214B.

VO did not check any of his documents. he had a NOC from college, invitation letter from my univ, sponsor documents and bank statements.

What shd he do for the 2nd interview???

Why make such a huge fuss over a graduation ceremony? How often do all of our family members attend similar convocations/ceremonies in India?

You should feel lucky that your parents will be able to attend it. Why do you want to ruin your brothers future chances to come to the US? Why do you want him to risk another rejection especially if he hopes to come to the US someday as a grad student?

The fact is that considering his age and current stage of his academic career he has absolutely NO economic or social ties to India that can be used as evidence of his intent to return. An NOC from his college is not going to prove that he will not stay back in the US and apply for some course here.

So if no circumstances have changed since his previous rejection please do not have him apply and be rejected again.
