My sister, brother-in-law and their 2 daughters attended visitor visa interview to come here for a month during this summer school vacation. There visa was rejected under Section 214(B) stating economic, social ties, financial strength and stating the doubt over they involving in unauthorized work. They did not ask or check any supporting documents that they took. We are planning to attempt again. I am not sure what is the change that we could make to overcome the visa officer's presumption and doubt over them coming back to India. Any help, recommendations or suggestions would be appreciated.
Following are the questions asked.
Q1) Why are you going to USA?
A1) My sister answered that my brother is in USA. We are planning to visit him in the next month during their daughter's school vacation.
Q2) How long are you going?
A2) 3 to 4 weeks
Q3) What are you doing? (Question to my brother-in-law)
A3) I have a Jewelery shop that I am running for the past 10 years.
Q4) Who is the proprietor?
A4) My mother.
Q5) Do you have any property under your name in India?
A5) Yes. I have property
Those were the questions. They were given the 214(B) form with a sorry, no visa this time.
Reg Q4, the business is under his mother's name and the documents that they took were supporting it but he is the one running the shop. He has properties under his name.
Thinking about the possible reasons why the VO did not have the confidence to issue the visa, 1) The family is young. My BIL is 31 and his 2 daughters are 6 and 4. 2) The proprietorship is not in my BIL's name. 3) Both my BIL and my sister own a 3-yr bachelor degree.
Now, what could or should we do to get the confidence of the VO that they will be returning back to India in a month?
In reality, my BIL was accompanying with my sister just to get the visa. He cannot travel to US with my sister and nieces due to his business. He cannot leave his shop for a month. Will it make a difference if my sister goes on her own along with her daughters to get the visa next time (in the next 10 days)? Will that give the confidence to VO that they will be coming back as her husband is here in India? On the other hand, will this be a contradiction to the previously applied visa application? Can the VO cross-check the previous attempts to get visitor visa? I am thinking this way because if the 4 go together again I am afraid that there is not much of change between the 2 attempts. I am not sure how to move forward.
Can you please share your thoughts on what could have gone wrong with the application? Any help or suggestions on the best way to move forward with the second application would be really appreciated.
