  • Tourist Visa with no stamp on passport on how long can stay in USA

    Hi All,

My aunt (73 yrs old) is visiting my family here in states but is about to go back home at the end of this month. Her visa is valid for 1 yr and doesn't expire until July 2020 but she came here on 9/28/2019 but will depart here around 3/26/2020 but when i looked at her passport it doesn't show her CBP stamped her passport stay until (usually only 6 months). I'm scared and puzzled at the same time because i thought all entries will go through CBP security or are they doing it electronically in the system and assume you only have 6 months to stay in the USA. Can i schedule with local USCIS office and ask about this or do i need to go elsewhere?

Furthermore, since the corona virus outbreak, her normal flight is Korean air so ffrom dfw to seoul but i will probably get her on a different path which might push her date back (i hope not) since it'll be over 6 months which i am scared she will overstay.

Has anyone experience this where CBP didn't stamp her passport valid until? My mother in law came visited us back in fall 2019 and she was only given stay until 6 months for tourist visa.

    Thank you all.

If the stamp is missing on her passport, you can go online & check her I94 dates there.

Thank you. I was able to find her arrival using that site but after looking at her passport closely it appears the stamp CBP is very light i can barley see what the date "admit until" is so i'm assumed 6 months from her arrival 9/29/2019. Will this be an issue when she departs and goes through security and the officer looks at her passport and airplane ticket and clearly doesn't make out the "admit until" date? I mean it just looks like the page wasn't even stamped i see some ink marks. Will the office know once they type her passport in the system when she arrived and how long she was permitted to state in the states? That I94.cbp.dhs.gov site didn't have her record for I94 traveler info but it did show travel history which is odd that it doesn't have her admit until ?

Basically, will she have issues when she leaves the country if the officer cant' see the stamp/make out the stamped on her passport "admit until". This was a bad part of the CBP stamping a passport when the ink was running out.

      Thanks.

No stamp on passport is fine, even if it is stamped & not readable. But check her I94 online - it is important for her to not overstay, because she didn't knew her end date.

Officer will have those dates anytime. So if you don't see the dates online, I would suggest contacting local CBP office.

Passport/Stamp is not checked when leaving USA, so she will be fine. But if she overstay in USA, she will have issues in her next entry.
